Advising Weapons Licensing of weapons transactions
Under section 35 of the Weapons Act 1990 and section 103 of the Weapons Regulation 2016, a licensed Queensland firearms dealer involved in a weapons transaction is required to provide the Queensland Police Service advice of the transaction in the way and manner decided by the Commissioner.
- For weapons transactions (other than under the National Firearms Amnesty) the way and manner is to be by Registered Post sent within 14 days of the transaction.
- For incoming weapons transactions under the National Firearms Amnesty (the acquiring Form 10) the way and manner is to be electronically via the online amnesty portal.
Under section 36 of the Weapons Act 1990 and section 104 of the Weapons Regulation 2016, a person who sells or otherwise disposes of a weapon with a lawful authority, justification or excuse (other than through a licensed Queensland firearms dealer or through a Queensland Police Officer) is required to provide the Queensland Police Service advice of the transaction in the way and manner decided by the Commissioner.
- The way and manner is to be in writing, accompanied by a statutory declaration detailing the disposal, sent by Registered Post within 14 days of the disposal.
Examples of this type of disposal include:
- if a licence holder travels internationally and disposes of a firearm while overseas, or
- donating a firearm to a State or Commonwealth museum for inclusion in its collection.
