1. Definitions and interpretation
1.1 In these Terms and Conditions:
- Definitions:
Department means the State of Queensland (represented by the Department of Tourism, Innovation and Sport or Queensland Police Service).
Eligible Individual means who at the time of application:
- is registered owner of the vehicle; and
- the vehicle registration number is registered with Department of Transport and Main Roads; and
- the vehicle registration is current; and
- the vehicle’s purpose of use is either passenger vehicle or light commercial; and
- the primary purpose is either private, farming or commercial; and
- the home (residential) address of the vehicle owner with Department of Transport and Main Roads is within the trial post codes.
Eligibility Criteria means the criteria in clause 3.1.
Eligible Vehicle Immobilisers means a vehicle immobiliser approved under the Queensland Government Vehicle Immobiliser Subsidy Trial.
Individual means the individual registered owner of the vehicle and is named on the Voucher.
Installation means the installation of an eligible vehicle immobiliser device fitted by an approved organisation utilising qualified installation staff which has been paid for by the Individual.
Installation Costs means sum of the cost of an eligible vehicle immobiliser device including GST and its professional installation costs including GST.
Registered owner is the individual/s registered as the nominated operator/s of the vehicle with Department of Transport and Main Roads.
Round means the particular Queensland Government Vehicle Immobiliser Subsidy Trial round that a Voucher is issued by the Department to an eligible individual.
Total Invoice Charge means the sum of the price charged for an eligible vehicle immobiliser device and the price chargers for installation, and sundry costs associated with the installation (including GST)
Trial post codes means –
- Cairns: (Trial zone postcodes: 4865, 4868, 4869, 4870, 4878, 4879)
- Mt Isa: (Trial zone postcodes: 4825)
- Townsville: (Townsville trial zone postcodes: 4810, 4811, 4812, 4814, 4815,4817, 4818)
Voucher means a voucher issued by the Department to an Eligible Individual under the Queensland Government Vehicle Immobiliser Subsidy Trial.
- Headings are for convenience and do not affect interpretation.
- “Include”, “includes” and “including” must be read as if followed by the words “without limitation”.
- A word importing the singular includes the plural (and vice versa).
- A reference to any legislation includes any consolidation, amendment, re-enactment or replacement of legislation.
- A reference to a program, government department or agency, website or grant management system in these Terms and Conditions, will include a replacement or renamed program, government department or agency, website or grant management system that is the same or similar.
2. Application of these terms and conditions
2.1 These Terms and Conditions apply to the application for and use of a Voucher under a Round of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program.
3.1 To be eligible to receive a Voucher, an Individual must:
- be an Eligible Individual;
- not have been issued with a Voucher for the same registered vehicle in the Round.
3.2 The following are not eligible to apply:
- a business registered with ASIC.
- a Company registered with ASIC.
- a licensed motor dealer registered with OFT.
- an organisation or association registered under the Associations Incorporation Act
- a body corporate registered with Dept Natural Resources
- a govt authority
- an organisation or association registered under Qld State Legislation
- a Trust/Trustee
4. Obligations for Individual applicants
For the purposes of this clause 4, ‘You’ means the Individual.
4.1 In applying for a Queensland Government Vehicle Immobiliser Subsidy Trial Voucher, you agree that:
- you are the registered owner of the vehicle;
- the Eligibility Criteria are met;
- the vehicle registration number is registered with Department of Transport and Main Roads; and
- the vehicle registration is current; and
- the vehicle’s purpose of use is either passenger vehicle or light commercial; and
- the primary purpose is either private, farming or commercial; and
- the registered home (residential) address of the vehicle owner with Department of Transport and Main Roads is within the trial post codes and
- must be installed between 1 July 2023 and 30 June 2024.
- all the information provided in the application is true and correct; and
- you will comply with these Terms and Conditions.
For the purposes of this clause 5, ‘You’ means the Individual.
5.1 You acknowledge and agree that a Voucher:
- can only be redeemed with an Organisation as listed on the relevant QPS website directory. The Department will not honour Vouchers redeemed with a non-registered organisation;
- can only be used for redemption against the total invoice charge for the purchase and installation of an Eligible Vehicle Immobiliser and not for any other purchases or charges;
- will expire on the expiry date as specified on the Voucher, if the Voucher is not presented to an Organisation by the expiry date on the Voucher, the Voucher is no longer valid cannot be redeemed;
- is not exchangeable or redeemable for cash;
- cannot be reused once redeemed by the Organisation.
5.2 You acknowledge and agree that:
- if the Voucher is used other than in accordance with these Terms and Conditions (e.g. you redeem the Voucher at a non-registered organisation) you will be required to pay the Organisation for the total cost of the installation. the outstanding fees;
- where the total invoice charge is more than $500 (GST Inclusive), you will be required to pay the difference;
- if the total invoice charge is less than $500 (GST inclusive), the Department will reimburse the Organisation the Total Invoice Charge. The balance is not redeemable in cash or towards any other charges.
- where a Voucher has not been redeemed, you may request in writing to the Department for a Voucher to be withdrawn in extenuating circumstances. 'Extenuating circumstances' is determined by the Department in its discretion and may include injury, illness or where the Organisation has not fulfilled their obligations under the Terms and Conditions of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program.
'Extenuating circumstances' does not include when the Individual is unaware of the Voucher expiry date or has simply forgotten to present the voucher to an Organisation. You may be asked to provide the Department with evidence to determine if 'extenuating circumstances' exist;
- you will receive notification from the Department whether your request to withdraw a Voucher (under 5.2e above) is approved and if approved;
- if approved under 5.2e above, after receipt of the written confirmation and provided that the relevant round for the Voucher is open when the request to withdraw a Voucher is made, you can submit an application in the same Round;
- you will make your own enquiries before deciding whether the installation of an approved vehicle immobiliser is suitable, effective and safe for your vehicle;
- you retain sole responsibility for your actions and decisions and will not bring any claim or action against the State of Queensland should the immobiliser not meet their expectations or perform as expected;
- you are responsible to determine whether the installation of an Eligible Vehicle Immobiliser will have any impact on your insurance or vehicle warranty;
- Vouchers will be issued until they are fully allocated or until the closing date for the Round as specified on the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program web pages, whichever comes first. The Department is under no obligation to make further Vouchers available;
- information (including personal information, but without limiting the details in the privacy collection notice in the application form) collected as part of your participation in the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program (including any feedback or survey results provided) may be disclosed by the Department to its contractor/s engaged for the purpose of evaluation of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program and for purposes associated with the administration of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program and your compliance with the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program terms and conditions and used by the Department and its contractor/s (if any) for this purpose;
- you must provide all information and documents reasonably requested by the Department in relation to a Voucher for the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program; and
- the Department may withdraw a Voucher at any time, in its discretion. Where the Department withdraws a Voucher under this clause, you will be notified by the Department. The Department will not be liable for any claim or costs because of a decision under this clause.
5.3 By presenting a Voucher to an Organisation, you agree that you are solely responsible for:
- complying with these Terms and Conditions;
- decisions taken in relation to costs, expenses, obligations or liabilities incurred in relation to the Eligible Vehicle Immobiliser, the installation and the Organisation; and
- confirming with the Service Provider or Organisation prior to presenting the Voucher:
- the Eligible Vehicle Immobiliser costs
- the installation costs
- warranty on the immobiliser and installation
- warranty implications and immobiliser suitability impacting the vehicle
- additional costs and/or requirements for the installation of the Eligible Vehicle Immobiliser for your vehicle.
5.4 Without limiting anything elsewhere in these Terms and Conditions, the Department will not be responsible or liable to you as the Eligible Individual, to the maximum extent permitted by law, for any of the matters described in this clause 5.3.
5.5 Eligible individuals should be aware that participation by an Organisation in the Queensland Government Vehicle Immobiliser Subsidy Trial does not mean that organisation has been endorsed, recommended or guaranteed in any way by the Queensland Government. You must rely upon your own enquiries to determine the quality and suitability of any Organisation.
5.6 Individuals agree to participate in short surveys (by email or SMS) 3 months (or later) after the Voucher has been received.
6.1 The Department reserves the right, at its discretion, to verify any information provided as part of the application, or before deciding whether to issue or accept the redemption of a Voucher. Verification may include any or all of the following
- requesting the provision of additional information;
- making enquiries with the relevant Organisation;
- making enquiries with Department of Transport and Main Roads; and
- anyone else.
6.2 Individuals must retain copies of all documents associated with its participation in the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program, and redeeming a Voucher, for 36 months after receiving the Voucher, to allow for post-redemption verification if required.
For the purposes of this clause 7, ‘You’ means the Eligible Individual
7.1 The Department may require You to repay the Voucher amount redeemed if:
- any information provided as part of, or accompanying, the Voucher application process is untrue, false or misleading;
- You received a Voucher and did not meet the Eligibility Criteria;
- You have not complied with its obligations in clause 5; or
- a Voucher was issued by the Department in error or by a mistake.
7.2 The Department may, in its absolute discretion, decide that due to the existence of exceptional circumstances an amount repayable under clause 7.1 of these Terms and Conditions is not repayable. In making such a decision, the Department may require the Eligible Individual to provide satisfactory evidence about the existence of exceptional circumstances.
8.1 The Department reserves the right, at any time, to:
- vary these Terms and Conditions, including the Eligibility Criteria or the process for redeeming the Vouchers;
- vary the maximum Voucher amount;
- vary the number of Vouchers available per Round;
- vary the Queensland Government Vehicle Immobiliser Subsidy Trial requirements;
- close early, suspend or stop the operation of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program;
- alter or change the opening and closing date for the round; and/or
- reduce or extend the period of the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program.
8.2 The Department will endeavour to take into consideration, where appropriate, the impact on outstanding applications for Vouchers, and Vouchers not yet redeemed, before any such action is taken.
8.3 Any action taken to close early, suspend or stop the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program will be notified on the QPS Queensland Government Vehicle Immobiliser Subsidy Trial pages.
9.1 The Department is not liable for any loss or damage, including personal injury, that may be sustained by the Eligible Individual or other person, while participating in in the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program and/or the installation of Eligible Vehicle Immobiliser.
The Department expressly disclaims all liability, to the extent permitted by law, for any loss, damage or other consequence whatsoever where direct or indirect, which may arise from the Eligible Individual’s participation in the Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program and/or the installation of Eligible Vehicle Immobiliser.
9.2 Eligible Individuals must not assign or subcontract their rights and obligations under these Terms and Conditions or in relation to a Voucher, without the Department’s written consent.
9.3 No rights under these Terms and Conditions will be waived except by notice in writing signed by the parent, carer or guardian and the Department.
9.4 The Queensland Government Vehicle Immobiliser Subsidy Trial vouchers program and all related documents are governed by the laws of the State of Queensland.
9.5 Where the Department has issued a notice to the email address provided as part of the Voucher application process (and stated on the Voucher), the notification will be deemed to have been received by you immediately upon receipt of electronic transmission confirmation.
